5th Season Fruit B.V. (hereinafter: “5th Season”) delivers freeze-dried fruit bites to its customers throughout the United Kingdom, Scotland, Ireland, and Europe. 5th Season processes personal data and other data in accordance with applicable laws and regulations. The considerations in this regard are set out in this privacy statement (hereinafter: “Privacy Statement”).

APPLICABILITY

This Privacy Statement applies to the processing of personal information provided by customers (hereinafter: “Personal data”), as well as data obtained from visiting and using the 5th Season website and the use of additional services.

HOW DOES 5th Season COLLECT PERSONAL DATA?

5th Season treats Personal Data confidentially and carefully. 5th Season collects Personal Data when you purchase something through their webshop and/or start a subscription whereby 5th Season delivers to you at the frequency specified by you when you request a package with fruit bites, or request information, participate in a survey or test, if you inquire about our activities, participate to a promotion, ask a question, respond to our website or otherwise contact us.

WHAT PERSONAL DATA DOES 5th Season COLLECT?

5th Season collects contact information such as your name, address, telephone number, email address, date of birth and bank details, data related to previous orders and preferences for certain flavors. We also store when and about what we have been in contact with you. In addition to the personal data you provide to 5th Season, 5th Season may collect, record and process additional personal data about your use of our website(s). This concerns data about the equipment you use, such as a unique device ID, the version of the operating system settings of the device you use to visit our website, as well as data about the use of our website(s), such as the time you visit us and the topics you view. The response (opens and clicks) to our e-mails are also recorded on an individual level. In some cases, Personal Data may be combined by 5th Season with information obtained from external sources (such as demographic and geographic segments). Based on all this data, we can provide you with a better service and better tailor the content of our services to your preferences. WHY DOES 5th Season COLLECT PERSONAL DATA?

5th Season processes Personal Data to fulfill your order in accordance with the agreement and to create an account so that you can easily change, pause or cancel your subscription in the future. We store data to process complaints and chargebacks and for our customer service, for example to answer questions. We analyze and improve our services based on the insights we gain from the use and visits of our websites and with the help of questions and reports to customer service. Personal data is also processed to keep you informed of our services and activities, for example because you have subscribed to our e-mail newsletter.5th Season will never provide your information to third parties for commercial use.

YOUR RIGHTS: CORRECTION, INSPECTION AND OBJECTION

You can gain insight into your data processed by 5th Season at any time and at no cost and adjust your data if you wish. HOW DOES 5th Season SECURE YOUR DATA?

5th Season engages third parties in the performance of its services. Insofar as these third parties process your data when performing the relevant services, they do so in the capacity of processor for 5th Season. 5th Season has taken technical and organizational measures to ensure that your data is only used for which third parties are engaged. The relevant service provider only receives the necessary data from 5th Season and the service providers are obliged to protect your Personal Data. We conclude agreements with all our processors in which we explicitly include this.
